Export Control Classification Number (ECCN) And Harmonized Tariff Schedule (HTS) Number

Overview

Magic Leap products and services, including any hardware, software, and related technology (“Products”), are subject to the Export Administration Regulations (EAR), a set of U.S. export regulations enforced by the U.S. Department of Commerce’s Bureau of Industry and Security (BIS).

Additionally, the U.S. Department of Treasury’s Office of Foreign Assets Control (OFAC) enforces a number of economic sanctions programs (together with the EAR and any other applicable export laws and regulations, “Export Laws”), that may restrict certain trade or financial transactions related to the Products.

The information on this page is intended to supplement Export Laws and assist you with the export of our Products. It does not constitute advice by Magic Leap, and does not obligate Magic Leap to keep you apprised of any relevant export controls. You are responsible for ensuring compliance with Export Laws (including obtaining any necessary licenses or approvals). We encourage you to seek competent legal counsel for advice before exporting any of our Products.

ECCNs and HTS numbers are subject to change without notice. Your use of these numbers or classifications is at your own risk without any recourse to Magic Leap. Magic Leap is in no way responsible for any damages whether direct, consequential, incidental, or otherwise, suffered by you as a result of using or relying upon any numbers or classifications provided on this page for any purpose.

Restrictions

Without limiting your responsibility to comply with Export Laws, under no circumstance may you export or otherwise transfer our Products without U.S. Government license or other approval:

• to Cuba, Iran, North Korea, Syria, or the Crimea, Luhansk, or Donetsk Regions of Ukraine;
• to any party prohibited for export by the U.S. Government, including, but not limited to, the U.S. Treasury Department’s Specially Designated Nationals and Blocked Persons (SDN) List, the U.S. Commerce Department’s Denied Persons List, the U.S. Commerce Department’s Entity List, the U.S. Commerce Department’s Military End User List, the U.S. State Department’s Debarred Parties List, and the U.S. State Department’s Nonproliferation Sanctions List; or
• for use in nuclear, rocket system or unmanned aerial vehicle, chemical and biological weapons proliferation, maritime nuclear propulsion, or military end use (in Belarus, Burma, Cambodia, China, Russia or Venezuela) activities.
